CCDW APPEALSUnder 11 Del.C. §1441, a person of full age and good moral character desiring to be licensed to carry a concealed deadly weapon for personal protection or the protection of the person's property may be licensed to do so when certain conditions, listed at 11 Del.C. §1441(a)(1), are complied with. To get a CCDW license, you must file an application with Superior Court in the county in which you live. A representative from the Department of Justice will then conduct a background investigation on you to determine whether you are a person of "good moral character" and then file a report with Superior Court recommending that the Court either approve or deny your application. According to 11 Del.C. §1441(d), the Court may or may not, in its discretion, approve any application, and in order to satisfy the Judges thereof fully in regard to the propriety of approving the same, may receive remonstrances and hear evidence and arguments for and against the same. If the Court denies your application, it will send you a letter informing you of same and advising you that you have ten (10) days of the date of the letter to request a hearing in Superior Court. The letter you send to the Court, requesting a hearing, will give the Court an opportunity to do just that....to schedule a hearing to hear evidence and arguments for and against the issuance of a CCDW permit for you.
