Delaware Firearms Charges Lawyer

I am familiar with the laws, the penalties and defenses for all state or federal weapons charges:

  • Felon in possession of a firearm
  • Carrying a concealed deadly weapon (CCDW) without a permit
  • Possessing illegal shotguns or automatic weapons
  • Possessing a firearm or deadly weapon while committing a felony (e.g., burglary, robbery, rape, aggravated assault or drug trafficking)

Prosecutors in New Castle County and other jurisdictions take weapon offenses very seriously. You could be charged with a felony, even if the victim's injuries were not fatal or life-threatening, or even if the person was not physically harmed at all.

A conviction for possessing a firearm in the commission of a felony carries a mandatory prison sentence of three years, on top of any sentence for the underlying crime. Possessing a deadly weapon (such as a knife or baseball bat) during a felony carries a minimum sentence of two years.

With the help of private investigators, I will review police reports and meet with witnesses and crime scene investigators to determine the circumstances of the crime and whether or not we have a viable defense. Did police recover a weapon? Was it a real gun? Was it loaded or even operable? Was it brandished during the crime? Was it on your person or stashed away? Was it a case of self-defense or protecting your family?

I also focus on fighting the underlying charges. If the prosecution has a weak case, we may be able to make the weapons charge or the felony offense (or both) go away to spare you from prison or secure a lesser sentence.
