Sentences for felony DUIs are as follows:
• 3rd offense (occurring within 5 years of the 1st offense): This is a Class G Felony, carrying a fine ranging from $1,500.00 to $5,000.00 and a prison term of 1 year to 2 years (90 days of which is a minimum mandatory prison term.) Additionally, persons convicted of this charge will have their driving privileges revoked inside the State of Delaware for a period of 24 months. If their BAC level was between .15 - .19, the revocation period increases to 30 months. If their BAC level was .20 or greater or if you refused the chemical test, the revocation period increases to 36 months. Finally, if you are licensed to drive in the State of Delaware, you will be required to have an ignition interlock device installed on your vehicle 12 months from the effective date of your revocation. The ignition interlock device shall limit conditional driving privileges to and from work, school, alcohol treatment programs and the interlock service provider.
