Delaware law comes down hard on people accused of drunk driving. If you have a Delaware driver's license, you implicitly agree to submit to a chemical test if a law enforcement officer asks for one. That is called implied consent.
You have the right to refuse a breath test. The only problem is that if you do, you may lose your driver's license for 1 year for a first offense, 18 months for a second offense and 24 months for a third offense.
Penalties for DUI are determined separately, and may include fines, jail time, alcohol education courses and the installation of an ignition interlock device in your car.

If you refuse a breath test and are arrested for DUI, you will receive a 15-day temporary driver's license. That will give me time to request a DMV administrative hearing to restore your driving privileges. If you skip the hearing, you will lose your license automatically.
In Delaware, the police may not stop you without reasonable suspicion. In the DMV administrative hearing I will ask the police officer to justify why he or she pulled you over, and explain any field sobriety testing which did occur.
