Underage Consumption
Lawyer Represents Clients Charged with Underage Drinking
If you or your child has been charged with underage drinking, you need an experienced criminal defense attorney. Underage consumption could result in license suspension, fines and community service.
Pursuant to 4 Del.C. §904(o), whether you are sentenced under Title 4 or under a City Code, any person who is convicted of a first offense for this charge may, upon reaching the age of 21, apply for an expungement of the record of the conviction and any indicia of arrest to the court in which you were convicted. An order granting expungement shall issue upon showing proof that you reached the age of 21, unless you failed to comply with the sentencing order or you had another Underage Possession/Consumption charge filed against you afterwards.
Do not plead guilty - contact me by e-mail or call 866-603-4647 to schedule a free initial consultation. I offer convenient appointments and pursue alternative solutions for individuals charged with underage drinking.
Experienced Criminal Defense Attorney
My name is Francis E. Farren, and I have worked exclusively in the criminal justice system for more than 24 years. Before starting Law Offices of Francis E. Farren, in 2006, I was a deputy attorney general for the Delaware Department of Justice. I sentenced hundreds of individuals, and I know firsthand how the prosecution works.
As your criminal defense attorney, I will thoroughly review the evidence against you and will poke holes in the prosecutor's case, and make sure your rights are protected. For example, I will review police reports and witness statements to determine if the police officers had a reasonable suspicion to pull you over.
To have a reason for arresting you, the police officers must give you a field sobriety test or a breathalyzer. I will work with a team of experts to determine if the field sobriety test was conducted fairly, and I will determine if the breathalyzer results were affected by incorrect calibrations or general maintenance of the device.
What Can I Do For You?
If you have been charged with underage drinking as a college student, you not only face penalties from the State but also from your school. I have a strong background working in this community and will work vigorously to reduce the charges against you.
In some circumstances, I may be able to reduce your fine or license suspension if you participate in community service or enter an alcohol or drug rehabilitation program. I will also negotiate with your college to try and keep you on good standing with financial aid or an athletics program.
