Shoplifting Is No Small Matter
On a first conviction or guilty plea for shoplifting, jail is unlikely. But the misdemeanor criminal record may haunt the person in employment opportunities, acceptance into college or the military, scholarships or athletic eligibility.
Under Delaware law, you could also face a separate civil action by the merchant for the value of the merchandise taken or $150, whichever is greater. If you fail to respond to the demand letter within 20 days, the merchant can sue for reasonable attorney's fees in addition to the requested amount.
If you have prior convictions for shoplifting or other theft charges, the elevated penalties may include jail time. If the value of goods stolen exceeds $1,500, shoplifting becomes a felony theft offense, punishable by up to two years in prison.
