What is Aggressive Driving?

The state of Delaware created the statutory crime of aggressive driving to try to tame the roadways and cut down on dangerous behavior. The law defines aggressive driving as any conduct that results in three or more convictions of these 12 offenses:

  • Failure to obey a traffic light or stop sign
  • Failure to yield the right of way
  • Failure to stop at the command of a police officer
  • Driving out of the lane
  • Passing on the right shoulder
  • Passing a (stopped) school bus
  • Failure to signal
  • Following too close
  • Entering the roadway unsafely
  • Unsafe lane changes
  • Speeding (exceeding the posted limit)
  • Excessive speed (too fast for conditions)

A first offense of aggressive driving is subject to a fine of $100 to $300 and/or 10 to 30 days in jail. The court will also require you to take a DMV behavior modification course to alter your attitude and driving habits. A conviction counts six points against your license toward suspension.

Any subsequent offense of aggressive driving within three years is punishable by fines of $300 to $1,000, a jail sentence of 30 to 60 days, and/or driver's license suspension for 30 days.
