Defense Against Driving Without Insurance Charges
Good people sometimes make mistakes, like driving without car insurance. In today's tough economy, layoffs and job cuts often make even minimal car insurance out of reach for many.
By law, all drivers in Delaware must carry at least $15,000/$30,000 for bodily injury, $10,000 in property damage and $15,000/$30,000 in personal injury protection (PIP) or "no fault" insurance.
What can you do if you are pulled over in a routine traffic stop and cannot show proof of insurance? The penalty for driving without insurance in Delaware is harsh, including heavy fines and possible loss of your driver's license.

Penalty for Driving without Insurance
If you cancel insurance coverage, your insurance company will let the Delaware Department of Motor Vehicles know. If they determine you were driving without insurance after cancelling the insurance policy or letting the policy lapse, you will pay a $100 fine per vehicle. After 30 days, you will pay a fine of $5 per day until you surrender your tags and registration, reinstate your insurance policy or the license tags expire.
If the police pull you over, the penalties are even worse. If you are convicted, you may pay $1500 or more in fines, and $3000 for each occurrence after that. You may also lose your driver's license for up to 6 months.
Defense of Driving without Insurance Charges
Serious charges require committed, serious representation. Here at the Delaware Law Offices of Francis E. Farren, I focus a large part of my practice on traffic violations defense. In my many years of practice, I have found possible answers for charges that seem indefensible, including:
- Did you mean to cancel your insurance policy?
- Did the insurance company receive the mailed payment?
- Did you receive notification your policy was about to expire?
- Was another family member entrusted with making the payment?
