Sometimes the charge of DUI is reduced to "Reckless Driving - Alcohol Related". If/when that happens, you are subjected to the normal penalties for Reckless Driving; however, you will be required to complete the DUI classes. The benefit of this reduced plea is that your license will not be revoked (like it would if you were convicted of DUI).
Penalties for Reckless Driving Convictions
First Offense — Fine of $100 to $300 and/or 10 to 30 days in jail (judge can suspend jail sentence).
Subsequent Offense — Within three years of former offense a fine of $300 to $1000 and or 30 days to 60 days in jail, although not required under law to do so, if the judge imposes any prison sentence, for a subsequent offense, it is a mandatory minimum sentence.
What Are Points Against Your Driver's License
Every time the court convicts you of a driving offense, the Department of Motor Vehicle assesses points against your driver's license. The more points you accumulate the more likely that you will lose your driving privileges. Here are some examples of the points that you can get:
- Reckless driving — Six Points
- Aggressive driving — Six Points
- Speeding — Two to Five Points
